Illinois BIPA & Statutory Compliance

Biometric Data Policy

Effective Date: October 17, 2026
Operated by Ashford Digital Group LLC, Richmond, Kentucky, USA

This policy explains how Ashford Digital Group LLC (operator of CheatSpyder, 212 N. 2nd St., Ste 100, Richmond, KY 40475, United States) handles biometric information created by the photo-search feature. It represents our publicly available written policy for retaining and destroying biometric information, including for the purposes of the Illinois Biometric Information Privacy Act (740 ILCS 14/15(a)), Texas CUBI, and Washington law.

1. What Biometric Information We Create & Why

When a user submits a photo search, our automated system detects the facial region in the uploaded photo and converts it into a mathematical vector representation (a “face template”). It creates similar ephemeral representations for faces detected in publicly available profile photos that are compared during that specific query.

A face template cannot be reverse-engineered or reconstituted back into the original photo. Face templates are used solely to compare the uploaded photo with publicly available profile photos to return possible match indicators for the search requested. We do not use them for any other purpose.

2. What We Never Do

  • No Commercial Sale: We never sell, lease, trade, or otherwise profit from biometric information.
  • No Third-Party Sharing: We never disclose biometric information to third parties, except to infrastructure providers who process it on our instructions under strict confidentiality agreements, or where legally compelled by law.
  • No Persistent Database: We never build a permanent database of facial templates or store biometric vectors to identify people in future queries.
  • No AI Model Training: We never use biometric information to train, fine-tune, or improve machine learning models.

3. Retention & Permanent Destruction Schedule

Biometric ItemDestruction Schedule
Face template from uploaded photoPermanently destroyed within 24 hours after search completion.
Face templates from public profile photosPermanently destroyed within 24 hours after search completion.
Uploaded photo filesPermanently destroyed within 24 hours after search completion.

In every case, biometric data is permanently purged no later than the earlier of (a) the date the purpose of the search is complete, or (b) 3 years after the user's last interaction, as required by applicable biometric privacy statutes.

4. User Consent & Deletion Inquiries

Prior to initiating a photo search, the user must confirm they possess the legal right to use the photo, that the person depicted is 18 years of age or older, and that they consent to the creation of an ephemeral face template for that specific search query.
